The defendant company operated quad bike adventure tours. The group travelled on public roadways and farmland. As the tour neared its completion, the group was travelling on a public road with a gravel surface, when the victim was found lying on the roadway, her quad bike on its side.

The victim sustained severe head injuries and died 10 days later in hospital when her life support was withdrawn.
