WorkSafe may exempt any person, or class of persons, from compliance with any provision of regulations. This applies to all regulations made under the Health and Safety at Work Act 2015.
Granting an exemption
WorkSafe cannot grant an exemption unless it is satisfied that:
- the extent of the exemption is not broader than is reasonably necessary to address the matters that gave rise to the proposed exemption and
- the exemption is not inconsistent with the purpose of HSWA.
Applying for an exemption
It is the responsibility of the Applicant to:
- submit the application using the appropriate form
- pay the fee (if any) when invoiced
- provide all necessary information to support the application.
Incomplete applications will not be processed.
Applicants should complete the form below to request an exemption (or an amendment to an exemption)
If you are applying for an exemption from the Health and Safety at Work (Hazardous Substances) Regulations 2017 please use the specialised forms.
An application for an exemption must specify the exemption being sought and if applicable demonstrate how safety will be ensured if the exemption is granted. Supporting information should be attached to the application.
