Facts in brief:
On 29 January 2021 WorkSafe received an allegation from a member of the public that there was no QR code on display at the business premises of the defendant.

Subsequently, between 9 February 2021 and 19 May 2021 WorkSafe engaged in correspondence with the defendant. In written response the defendant repeatedly alleged duress, threats and “gas lighting” by the Inspector and WorkSafe as a whole. Responses often included abusive comments of a personal nature.

The defendant was at all times the owner of the business and in control of the workplace. After multiple requests, warnings and notices, he failed to ensure that a QR code was displayed in a prominent place at the workplace they owned as at 19 May 2021. This failure was deliberate.
