On the day of the incident the victim arrived at the ARDC and communicated with a Supplychain forklift operator regarding loading.
While he was in the process of opening the curtains on his truck, he was hit by a reversing forklift. Unbeknownst to the victim a second forklift driver had decided to assist.
The victim sustained multiple fractures in his left lower leg, ankle and foot.
The Defendant was aware there were no driver safe zones at the ARDC and was also aware dual loading occurred on occasion. It failed to consult, co-operate and co-ordinate with other PCBUs about a safe system of work for the truck drivers to follow at the ARDC.
