WorkSafe New Zealand has granted an exemption (SEP2314) to Skibo Limited from compliance with regulation 11.33(1)(e) of the Health and Safety at Work (Hazardous Substances) Regulations 2017 in relation to the building that is a retail shop at 8 Okara Drive, Whangarei (the Building).
The exemption is granted by WorkSafe in accordance with section 220 of the Health and Safety at Work Act 2015 (the Act) on the basis that WorkSafe is satisfied that—
- the extent of the exemption is not broader than is reasonably necessary to address the matters that gave rise to it; and
- the exemption is not inconsistent with the purpose of HSWA because the risks associated with the lesser fire resistance rating and separation of the common wall with a neighbouring building can be mitigated by improved fire protection measures and limiting the quantities of flammable liquids that can be held in the Building; and
- this is a situation where there is good reason to grant an exemption under section 220(1).
The exemption comes into effect on 21 May 2026 and expires on 21 May 2031 unless it is replaced sooner or revoked.
