WorkSafe has exempted Oceana Gold from compliance with regulations 213(3)(a) and 214(1) of the Health and Safety at Work (Mining Operations and Quarrying Operations) Regulations 2016.

The exemption has been granted by WorkSafe in accordance with section 220 of the Health and Safety at Work Act 2015.

The exemption is made subject to the following conditions:

  1. The exemption only applies in respect of Oceana Gold's Macraes opencast mining operation and Frasers underground mining operation
  2. Oceana Gold must ensure that:
      1. every plan required by regulation 213 of the Regulations (the on-site plan)–
        • is prepared using the local mine grid and to a suitable scale; and 
        • includes the details specified in regulation 217
      2. a version of the on-site plan (the WorkSafe plan) is given to WorkSafe–
        • annually, not later than 31 March in respect of the on-site plan current as at 31 December of the preceeding year; and 
        • whenever any significant changes are made to the on-site plan
      3. the WorkSafe plan–
        • is prepared using the New Zealand Geodetic Datum 2000 and to be suitable scale; and 
        • includes the details specified in regulation 217
      4. every on-site plan and WorkSafe plan is prepared by a mine surveyor who has the qualifications specifed in regulation 213(4).

This exemption takes effect on 30 November 2018 and expires on 30 November 2023 unless it is sooner replaced or revoked.
