WorkSafe New Zealand has granted an exemption (HS2403) to HWR Hydrogen Limited from compliance with 17.17(1)(a) and 17.17(4) of the Health and Safety at Work (Hazardous Substances) Regulations 2017 in relation to their hydrogen storage located at 10 Lake Street in Clifton, Invercargill.
The exemption is granted by WorkSafe in accordance with section 220 of the Health and Safety at Work Act 2015 on the basis that WorkSafe is satisfied that—
- the vessels which make up the MEGS pods have been verified to comply with AD-2000 Merkblatt PED 2014/68/EU & PECPR regulations; and
- the stationary tanks are fitted with pressure relief valves, and the mitigations imposed maintain an extremely low likelihood of fire or explosion; and
- the intended location of installation complies with the relevant public and protected place separation distance requirements
The exemption comes into effect on 29 September 2025 and expires on 29 September 2030 unless it is replaced sooner or revoked.
