WorkSafe has granted an exemption (HS2104) to Coca-Cola Amatil (N.Z.) Limited from compliance with regulation 17.56(3)(a)(i) of the Health and Safety at Work (Hazardous Substances) Regulations 2017 in relation to the vapouriser at 41 Brightlings Road, Hillsborough, Christchurch.

The exemption is granted by WorkSafe in accordance with section 220 of the Health and Safety at Work Act 2015 on the basis that WorkSafe is satisfied that—

  • the exemption is not broader than is reasonably necessary to address the matters that gave rise to it as the exemption applies only to this single vapouriser and its separation to the neighbouring protected place; and
  • the exemption is not inconsistent with the purpose of HSWA as the risk associated with the non-compliance is mitigated by an intervening wall.

The exemption comes into effect 13 October 2021 and expires 13 October 2026 unless it is replaced sooner or revoked.
