WorkSafe has amended exemption SEP2010 granted to Amcor Flexibles (New Zealand) Limited (Amcor) on 10 February 2023 in relation to compliance with regulation 11.36(2) of the Health and Safety at Work (Hazardous Substances) Regulations 2017. This amendment (SEP2010A) concerns the fire resistance rating requirement of the walls in the printing hall and laminating hall of Amcor’s facility located at 74 Brandon Street, Christchurch.
The amendment is granted by WorkSafe in accordance with section 220 of the Health and Safety at Work Act 2015 (the Act) on the basis that WorkSafe is satisfied that—
- the extent of the amendment is not broader than is reasonably necessary to address the matters that gave rise to the proposed amendment; and
- the amendment is not inconsistent with the purpose of the Act as it does not result in increased health and safety risks to workers and other people, because:
- alternative engineering solutions will be applied to meet the fire resistance ratings for the walls in the printing and laminating halls; and
- there are existing fire protection measures in place under the conditions of SEP2010, all of which are in compliance.
- this is a situation where there is good reason to grant an amendment under section 220(1) of the Act.
The amendment takes effect on 28 July 2025 and expires on 20 February 2028 unless it is replaced sooner or revoked.
This amendment is given the reference SEP2010A.
