WorkSafe has exempted Contact Energy Ltd from compliance with regulations 16.20 and 16.34 of the Health and Safety at Work (Hazardous Substances) Regulations 2017.

An exemption has been granted by WorkSafe in accordance with section 220 of the Health and Safety at Work Act 2015 to Contact Energy Ltd to allow seven LPG tank wagons to receive tank wagon design record numbers in accordance with the attached schedule.

The exemption is made subject to the following conditions:

a.  Contact Energy Ltd must operate and maintain these tank wagons in accordance with Part 16 (except for regulations 16.20 and 16.34) of the Health and Safety at Work (Hazardous Substances) Regulations 2017.

b.  Contact Energy Ltd must increase the static roll threshold to 0.45g when major works are undertaken on the sub-frame of a tank wagon or prior to the expiry date for the exemption.

c.  Contact Energy Ltd must fix the issued TAN number to the respective tank wagons in a manner that will ensure it will remain legible.

The exemption takes effect on 6 June 2018 and expires on 6 June 2023 unless it is sooner replaced or revoked.
