Notifiable incidents at Major Hazard Facilities

If a notifiable incident has occurred at a major hazard facility, the operator of the facility must notify us. Notifiable incidents are those declared under regulation 33 of the Health and Safety at Work (Major Hazard Facilities) Regulations 2016 (see below). Some notifiable incidents under the Major Hazard Facilities Regulations may also be notifiable under section 24 of the Health and Safety at Work Act 2015 (HSWA).

When a notifiable incident occurs at a Major Hazard Facility

 

NOTIFICATION TYPE ACTION

Notifications of notifiable incidents under the Health and Safety at Work (Major Hazard Facility Regulations) 2016 (see regulation 33)

OR

Under both the Health and Safety at Work Act 2015 AND Health and Safety at Work (Major Hazard Facility Regulations) 2016

You must notify us using the fastest means available to you.

If using the form, fill in as much detail as is known at the time of notification and then email it to healthsafety.notification@worksafe.govt.nz.

If your incident is being notified under both the Act and the Regulations you will need to preserve the scene of the incident until a WorkSafe inspector arrives, or you are otherwise directed.

Keep records of all notifiable events.

 

Subsequent to the initial notification, two written reports must be submitted to WorkSafe.

 

The initial written report must be submitted to WorkSafe by the later of 7 days after the operator becomes aware of the notifiable incident or any other date that WorkSafe specifies in writing. The report must contain all information required in Part 1 of Schedule 4 of the Regulations. You may use the Notifiable incident – Major Hazard Facilities Form [PDF 338KB] and fill in all of the information in Part 1.

 

The final written report must be submitted to WorkSafe by the later of 30 days after the operator becomes aware of the notifiable incident or any other date that WorkSafe specifies in writing. The report must contain all information required in Part 2 of Schedule 4 of the Regulations. You may use the Notifiable incident – Major Hazard Facilities Form [PDF 338KB] and fill in all of the information in Part 2.

If using a form, this can be submitted online or emailed to healthsafety.notification@worksafe.govt.nz.

 

Notify us as soon as possible

 

Preserve the scene of the incident until a WorkSafe inspector arrives, or you are otherwise directed.
